Terms of Service

These Terms of Service (“Terms”) govern access to QuickKOT websites and software, including quickkot.com, app.quickkot.com, the Partners & Affiliates programme, the invite-only partner portal, and related services (the “Service”). By creating an account, applying as a partner, or using the Service, you agree to these Terms. If you use the Service for a restaurant or company, you confirm you have authority to bind that organisation.

1. The Service

QuickKOT is a cloud restaurant point-of-sale: orders, kitchen tickets, bills, reports, and related features depending on your plan. We may change, suspend, or discontinue features. The Service is provided from our systems; you need a compatible device and internet connection.

2. Accounts

You must provide accurate restaurant and contact details and keep credentials confidential. You are responsible for activity under your account, including staff logins. We may refuse, suspend, or close accounts that violate these Terms or applicable law. You may sign in with email or a third-party identity provider (such as Google) subject to that provider’s terms. A partner login is a separate account from restaurant staff. It uses email and password only and does not open POS, kitchen tickets, or staff logins.

3. Plans and payment

The Basic plan may be offered at no charge with usage limits. Paid plans (Economy, Premium, Enterprise) are billed in INR as described on our pricing page, plus applicable taxes. Enterprise is sold by agreement — contact support@quickkot.com. Fees are generally non-refundable except where required by law. We may change prices with notice to the account email.

4. Your content and data

You retain rights to menus, orders, logos, and other data you submit. You grant us a licence to host and process that data solely to operate and improve the Service, comply with law, and provide support. You must not upload unlawful content or data you do not have the right to use. You are responsible for backups you need beyond our standard hosting.

5. Acceptable use

You must not: attempt unauthorised access; probe or overload our systems; share accounts in a way that bypasses plan limits; use the Service to commit fraud; reverse engineer except as allowed by law; or resell the Service without our written consent. An invited partner may refer restaurants under these Terms; that is not a right to resell the Service.

6. Intellectual property

QuickKOT, the QuickKOT logo, and the software (excluding your data) remain our property or that of our licensors. These Terms do not transfer ownership. Feedback you send may be used without obligation to you.

7. Third-party services

The Service may connect to payment networks, messaging, email (including transactional email providers), identity providers, and printers. Those services are governed by their own terms. We are not responsible for outages or acts of third parties.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that kitchen tickets, tax calculations, or reports meet every regulatory requirement in your jurisdiction — you remain responsible for tax, FSSAI, and local compliance.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKKOT AND ITS SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, SALES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THAT PERIOD (OR, IF YOU ARE ON A FREE PLAN, INR 1,000). Some places do not allow certain limits; in those places our liability is limited to the greatest extent allowed.

10. Indemnity

You will defend and indemnify QuickKOT against claims arising from your use of the Service, your data, or your breach of these Terms, except to the extent caused by our wilful misconduct.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or if we must do so for legal or security reasons. After termination, your right to use the Service ends. We may delete data after a reasonable retention period unless law requires otherwise. Partner logins and the Partners & Affiliates programme are also covered in section 14.

12. Changes

We may update these Terms. Continued use after the “Last updated” date constitutes acceptance of the revised Terms. Material changes will be indicated on this page and, where appropriate, by email.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect our intellectual property or the security of the Service. Consumers in some countries may have mandatory local rights that this clause does not override.

14. Partners & Affiliates

QuickKOT may invite selected applicants from quickkot.com/partners to an invite-only partner portal on app.quickkot.com. Applying or being invited does not make you an employee, agent, or representative who can bind QuickKOT.

Commission, hold, and payout rules are agreed when we invite you. They are not a public rate. Figures on the portal are operational; they are not tax, GST, or TDS advice. You are responsible for your own tax filings. Payouts need bank or UPI details on file and may apply TDS where we are required to.

You may share your referral signup link. You must not invent a commission rate, promise restaurant features we do not offer, or access a restaurant’s POS.

We may disable a partner login. Any partner found in wrongful activities or not abiding by these Terms may be suspended from the Partners & Affiliates programme. Open commission stays on the ledger unless we reverse it under these Terms. Earnings are not guaranteed.
